  • no hotel-like operation is created

  • the rental is predominantly short-term (by the day or week)
  • the apartment effectively serves as a substitute for a vacation home
  • there is no longer any discernible social use of the living space
  • excessive rents are deliberately circumvented by furnishing, for example, when very simple or purely symbolic furnishings are used to suggest furnished living without any discernible added value for the tenant.

District offices are increasingly checking carefully whether this is still housing in the traditional sense. Neighbors are now also being actively encouraged to report any possible irregularities via registration portals, which can also lead to legally rented apartments being subject to review procedures.

Is a permission required?

According to the information available to us, no permission for change of use is required for furnished accommodation as long as the use is legally classified as residential. However, in special cases (e.g., very short rental periods or mixed forms), a permission may be required.

Consequences of violations

Anyone who misuses residential space risks:

  • Fines of up to €500,000
  • Prohibitions on use
  • Requirements for restoration or re-letting

In practice, other regulations often play a role here, such as the Housing Protection Act, environmental protection in building law, and housing regulations such as tenancy law, rent indices, and rent controls. Temporary housing in accordance with § 549 BGB (German Civil Code) is also relevant in this context.
