Rent increase with the rent index
The rent index is used to justify a rent increase. Apartments are compared with the characteristics of the rent index. With the help of the rent index, the rent can be increased to the values of the rent index. Due to the cap, the increase may only be increased by a maximum of 15% every three years. If no rent index is available, the rent increase can be justified with a comparative apartment.

In contrast to the rent index, the rent control primarily takes effect in the case of a new rental. The rent may not exceed the local rent index by more than 10%. Accordingly, the rent brake can only be applied when the rent is 10% above the rent index.
Rental prices continue to rise! Prices in Berlin have doubled since 2012. Purchase prices also continue to rise. Prices have doubled since 2016 as well and they continue to rise.
The official rent index in Berlin is currently 6.79 euros in 2021, but according to current evaluations of apartment advertisements, it is 26.86 euros per square meter. In Germany it is 11.89 euro per square meter. In Berlin, therefore, the value is higher than the average for Germany, and asking rents are almost twice as high.
Basically, a distinction is made between a simple and a qualified rent index. A simple rent index contains an overview of the local comparative rent and is prepared and recognized by the municipality or by landlord and tenant representatives. A qualified rent index, on the other hand, is drawn up according to recognized scientific principles. In Berlin, the qualified rent index is applied.
Since 1st of July 2022, cities with more than 50,000 inhabitants are obliged to introduce a rent index. From a population of 100,000, it is mandatory to create a qualified rent index. In 1987, the rent index was introduced in Berlin and since 2003 it has been a qualified rent index.
German cities such as Hamburg, Munich, Mannheim, Düsseldorf, Erfurt, Dortmund, Essen, Bielefeld, Frankfurt, Hanover, Leipzig, Nuremberg, etc. also have a rent index. The rent index in Munich is the highest in Germany. It is followed by the cities of Frankfurt, Stuttgart and Berlin. In Munich, the rent index has now risen by 21% in 2023 compared with the 2021 rent index.
