The property tax return submission is an additional and separate submission from your traditional / annual income tax return.

What is the property tax (Grundsteuer)?

  • The German government charges a property tax annually for all types of real estate.
  • For privately owned apartments, the tax is usually automatically debited from your account by the tax office on a quarterly basis.
  • You will find your tax rate in your property tax notice (Grundsteuerbescheid), which you received when you purchased your property.

  • The property tax rate is based on data from World War II.
  • These values will be updated and recalculated starting in 2025.
  • Therefore, a one-time property tax declaration has to be submitted this year.

Who has to submit a property tax declaration?

  • Owners of apartments, houses, land, farmland, etc. are obliged to pay property tax.
  • Every person who owns said property must file a property tax return this year.
  • The property tax return submission is an additional and separate submission from your traditional / annual income tax return.

Who pays the property tax for a rented property?

  • As a rule, the owner is responsible for paying the property tax.
  • In the case of long-term rentals, it can be apportioned.
  • In the case of furnished accommodation, the property tax is often part of the flat-rate rent.

When and how must the property tax declaration be filed?

  • The property tax return must be submitted by January 31st 2023.
  • It is submitted by a 3rd party on behalf of the owner at their request, by the owner himself/herself via the tax software Elster or with the help of a tax advisor.
  • The reference point is the value of the property on 01 January 2022.

What happens if the property tax declaration is not submitted?

  • In the case of a missed submission, we suspect that – as is usual with other tax levy obligations – an automatic calculation of the fee will take place after a reminder from the tax office.
  • This can be disadvantageous for owners.
